The following terms and conditions apply to purchases made from Akademibokhandeln Bokus AB (hereafter referred to as Bokus) in Sweden, and abroad via the internet, by an individual consumer (hereafter referred to as the Consumer) over the age of 18 or by a corporate client (hereafter referred to as Corporate Client).

1. Registration

In order that Bokus is able to fulfil its contractual obligations, customers must, in conjunction with the first order they place:
| a. |
register their details in the Bokus customer database by providing an email address, a postal address, their name, personal identity number or organisation number. Customers who choose to make payment by credit card are not obliged to provide their personal identity number. (If Corporate Clients wish to be invoiced exclusive of VAT, they must in certain cases also provide their VAT-registration number, see below, paragraph 2.3) |
| b. |
choose and register a user-name and password; and |
| c. |
give their permission for Bokus and/or its financial services company to store their personal details in their customer database (applies only to Consumers) |

| 1.2 |
Bokus also uses the information in its customer database for marketing purposes. By accepting these terms and conditions, the Consumer agrees to such use of his/her personal details. The Consumer can withdraw permission for such use of personal information at any time by contacting Bokus Customer Services.
|
| 1.3 |
In conjunction with every order placed, customers must read and accept these terms and conditions.
|
| 1.4 |
Customers must store their user-names and passwords in a safe place, and must only supply these to such a person who is authorised to place orders on the customer's behalf.
|
| 1.5 |
The Bokus customer database is confidential. Bokus will not pass any information held in the database to any third parties outwith its affiliated companies, and will only use this information in accordance with the statutes of law.
|
| 1.6 |
Charging of VAT: Corporate Clients can choose to provide a VAT-number if they wish. Bokus does not normally apply VAT to orders delivered outwith the EU, but for orders delivered within the EU, VAT will be debited where customers have not provided a valid VAT-registration number in their registration details.
Individual consumers within the EU must always pay VAT, whereas consumers outwith the EU do not pay VAT.

2. Prices

| 2.1 |
The relevant price of an item, including VAT, is the price stated in the Bokus pricelist at www.bokus.com at the time the order is placed. |

| 2.2 |
Deliveries within Sweden:
A delivery charge of SEK19 will be applied to all orders. If an order involves "separate deliveries", as in paragraph 5.3 below, a delivery charge of SEK19 will be applied to each separate shipment. Separate deliveries as described in paragraph 5.4 below, will involve no extra costs for the customer.
Deliveries outwith Sweden:
For overseas shipments, the delivery charges will calculated in accordance with the fees of the Swedish Post Office.
NB! Any import or customs fees that may arise are to be payed by customer.

| 2.3 |
Customers may be invoiced exclusive of VAT in the following cases:
a. the order is for delivery to a non-EU country, or b. the order is for delivery to an EU country other than Sweden and the Corporate Client has provided a VAT-registration number for the country in question in its registration details at www.bokus.com.
In all other cases customers will be charged Swedish VAT.

3. Terms of payment

| 3.1 |
For deliveries within Sweden: Payment may be made:
| a. |
via invoice; or |
| b. |
by bank debit or credit card
|
|

For deliveries outwith Sweden: Payment should be made by bank debit or credit card, if no other arrangements have been agreed.
|
| 3.2 |
Deliveries within Sweden: If payment is made via invoice, Consumers should pay within fourteen (14) days, and Corporate Clients within thirty (30) days of the date on the invoice.
For deliveries outwith Sweden: Payment should be made by bank debit or credit card, if no other arrangements have been specifically agreed.

| 3.3 |
If paying by card, customers must supply the card number and expiry date. Customers must ensure that there are sufficient funds available in their account until Bokus has received payment. If there are insufficient funds available, Bokus reserves the right to send an invoice for the amount due, or to instigate legal proceedings.

| 3.4 |
If payment is not made within the time stipulated, interest will be charged in accordance with consumer law (at present, base rate + 8%) plus a reminder charge of (at present) SEK 50, in accordance with the law.
|
4. Placing an order

| 4.1 |
Orders may only be made through our website www.bokus.com, unless otherwise specifically agreed with Bokus in advance.
|
| 4.2 |
All communication between the parties shall be conducted by email. In addition, communication may be conducted by other means if it is in connection with the issues described in paragraphs 6.1 and 9.3. Customers agree to check their email regularly after placing an order.
|
| 4.3 |
The purchase order becomes legally binding once Bokus have sent confirmation of the order by email. Orders are accepted subject to the availability of the product ordered.
|
| 4.4 |
Prior to delivery, customers have the right to cancel part or all of their order by email. Here, delivery entails that the customer has received at least part of the order or a dispatch note that the order is ready for collection from the Post Office.
|
5. Delivery
|
| 5.1 |
Books are normally sent according to the information listed for individual titles. Delivery is normally by Post Office Post Package or envelope, and for Corporate Clients by Post Office Company Package or envelope.
|
| 5.2 |
Bokus will immediately inform customers by email if delivery time is expected to be longer than stated, in which case customers will have the right to cancel their order by email.
|
| 5.3 |
When customers order items with different estimated delivery periods the first delivery will be made according to the longest such period. If the customer chooses "separate deliveries", each shipment will be delivered in accordance with the specific estimated delivery period for the item(s) involved and the customer will incur a delivery charge for each shipment.
Please note: The "separate deliveries" method is only available for shipments within Sweden.

| 5.4 |
If the items are shipped in more deliveries than the customer chose at the time of ordering, the customer will not incur any extra costs, see paragraph 2.2 above.

| 5.5 |
While the order is in transit from Bokus to the customer, Bokus will be liable for any loss of or damage to the products. While the products are in transit from the customer to Bokus the customer will be liable for any loss of or damage to the products.

6. Returns
|
| 6.1 |
Customers have the right to return goods. Customers must inform Bokus of their intention to return goods within fourteen (14) days of the date the customer received them. Return shipping charges, as listed in the Post Office's pricelist, shall be paid by the customer. If goods are being returned from abroad, all shipping charges for the package shall be paid by the customer.

| 6.2 |
The right of return does not apply to packages which have not been collected from the Post Office, see paragraph 6.6 below, neither does it apply to a sound, picture, or film recording whose packaging has a security seal, nor to computer software whose packaging has a security seal, in the event that these seals have been broken.

| 6.3 |
Notification of a return shall include the following information:
| a. |
the order number, |
| b. |
the invoice number and |
| c. |
the title(s) of the item(s) to be returned. |
This information is required for administrative purposes.
|
| 6.4 |
Before returning the goods, customers should wait until they have received a returns number and returns address from Customer Services.
|
| 6.5 |
Returned goods must be unused and undamaged. This applies unless the product has been destroyed or altered due to circumstances that cannot be attributed to the customer.
|
| 6.6 |
If the customer fails to collect a delivery, Bokus will debit the
customer, at present, SEK 149 + all shipping charges related to the package,
to reimburse postage, packing and other costs.
|
| 6.7 |
If a customer exercises the right to return goods, Bokus will promptly, and within thirty (30) days reimburse the customer for the amount he/she paid to Bokus. This period begins from the date Bokus received notification from the customer of his/her intention to return the goods.

7. Complaints
|
| 7.1 |
If a customer receives a different product to the one ordered or the product is damaged, the customer must immediately notify Bokus of the problem. Faulty goods may be returned in accordance with the instructions supplied by Bokus. The customer will not be debited for return delivery charges. Returns must not simply be sent without postage (cash on delivery), and must only be sent after Bokus have been notified.

Disputes over whether a product is faulty or damaged can be referred to the Swedish National Board for Consumer Complaints.
|
8. Liability
|
| 8.1 |
Outwith that which is stated above, and, with regard to Consumers, outwith that which is stipulated in the Swedish Consumer Purchases Act, Bokus shall not be liable for faults and/or delays, and shall not be liable for any damages either directly or indirectly.
|
9. Miscellaneous
|
| 9.1 |
After a customer has placed an order, Bokus may not alter the terms and conditions.

| 9.2 |

Complaints from individual consumers should be sent by email to kundservice@bokus.com, from corporate clients to order@bokus.com, and from overseas customers to export@bokus.com, or by letter to Bokus AB, Södergatan 28, 211 34 Malmö.

| 9.4 |
9.4 All purchases made under these terms and conditions shall be subject to Swedish law. Any dispute arising in relation to purchases made under these terms and conditions shall only be heard in a Swedish court, and in the first instance Malmö District Court.
